Any person younger than 21 years old is considered underage when it comes to alcohol possession and consumption. Any person making alcohol available to an underage individual can be charged with contributing to the delinquency of a minor. A conviction can bring up to a year in jail and a $2,500 fine.
If you are convicted for possession of alcohol, you may be required to pay fines, fulfill community service, attend Virginia's Alcohol Safety Awareness Program (ASAP/VASAP) and/or go through substance abuse assessments. You may also be eligible for a deferred finding, in which the charges may be dismissed after one year, assuming you meet certain conditions set by the court.
Drivers with a blood alcohol level over .05 may face DUI/DWI charges.
Conviction for consumption while driving is considered a class one misdemeanor. It brings a driver's license suspension, 50 hours of community service and/or a fine. You may be eligible for deferred finding. If your blood alcohol level was over .05, you may be charged with drunk driving.
